Uninterrupted rest between two shifts
(1) The employer is required to schedule working hours in such a way that the employee has an uninterrupted rest period of at least 11 hours between the end of one shift and the start of the next. Employees under the age of 18 are entitled to a rest period of at least 12 hours within any 24-hour period.
(2) The rest period referred to in paragraph 1 may be reduced to no less than 8 hours within any 24-hour period for employees over the age of 18, provided that the subsequent rest period is extended by the amount of time the previous rest period was shortened. a) in continuous operations, in cases of unevenly scheduled working hours, and during overtime work, b) in agriculture, c) when providing services to the public, especially
- in public catering,
- in cultural institutions,
- in telecommunications and postal services,
- in healthcare facilities,
- in social care facilities,
When creating work schedules in shift editing, it is important to ensure proper allocation of working hours.
Work schedules, whether they involve fixed hours, flexible work, fully flexible work, or free work, should have a time interval of at least 11 hours between the end of one work schedule and the start of the next (at least 12 hours for employees under the age of 18) within any 24-hour period.
This time interval may be reduced to 8 hours within any 24-hour period for employees over the age of 18, provided that the subsequent rest period is extended by the amount of time the previous rest period was shortened.
The employee works on Wednesday from 3:00 PM to 11:30 PM. The employer can schedule the employee's next shift on Tuesday no earlier than 10:30 AM. If the employee is required to work overtime from 9:00 AM to 10:30 AM, this is allowed. However, the employee will have only 9.5 hours of rest, and therefore, after the Tuesday shift, a rest period of at least 12.5 hours is required.

The rest period between the end of one shift and the start of the next, reduced as per Section 90, Paragraph 2, may be compensated for employees over the age of 18 during seasonal agricultural work by providing the rest period within the following 3 weeks from the reduction.
Public holidays
(1) Non-working days are the days on which the employee has uninterrupted rest during the week, as well as public holidays.
(2) The employer may only require work on non-working days in exceptional cases.
(3) On the day of uninterrupted weekly rest, the employer may only require the employee to perform essential tasks that cannot be carried out on working days: a) urgent repair work, b) loading and unloading work, c) inventory and year-end closing work, d)work carried out in continuous operation for an employee who failed to show up for their shift, e) in the event of natural disasters and other similar exceptional circumstances, f) work necessary to meet the life, health, educational, cultural, physical, and sporting needs of the population, g) work in transportation, h) feeding and caring for animals.
(4) On a public holiday, the employer may only require the employee to perform tasks that can be assigned on days of uninterrupted weekly rest, work in continuous operation, and tasks necessary for guarding the employer's premises.
(5) On non-working days, the employer may only require the performance of tasks listed in paragraphs 3 and 4 a maximum of twice within a period of 4 consecutive weeks, if the time account system applies as per Section 86, Paragraph 4.
(6) For an employer where the employee works night shifts, the non-working day begins at the time corresponding to the start of the shift that is the first scheduled shift of the week, according to the shift schedule. The provisions of the first sentence may also be applied for the purposes of determining the right to wages or salary, remuneration from an agreement, and calculating the average earnings.
On a public holiday, a non-working employee is entitled to compensation for the wages they would otherwise lose due to the holiday.
If the ‘Work over holiday‘ option is set to No in the shift editing and the holiday falls on a day when the user normally works (based on their shift schedule), the user is entitled to holiday pay. The holiday day in the Plan tab is without a work schedule (no work is expected from the user), and this day is marked as a holiday in the report (holiday column). The hourly value of the holiday reflects the value set for working hours in the work schedule.
For a worked public holiday, the employee is entitled to both wages and compensatory time off equivalent to the shift worked on the holiday, even if they would otherwise be entitled to rest.
If compensatory time off is granted for work on a public holiday, the ‘Work over holiday‘ option is set to No in the shift editing, and the shift plan for the holiday is entered as ‘Compensation‘ in the user’s attendance. A ‘Private leave‘ plan is entered for the compensatory time off day. The holiday day is marked as a holiday (small icon) with a work plan (compensation) in the Plan tab. The worked time for this day is tracked and counted toward the monthly working time fund. In the report, the worked time is recorded as regular worked hours, and the day is also marked as a holiday (holiday column). The hourly value of the holiday reflects the value set for working hours in the work schedule.
If the employee and employer agree, instead of compensatory time off, an additional payment equivalent to the average earnings for the time worked can be provided. In this case, the employee will receive double the compensation.
If the employee and employer have agreed on working on a public holiday, the ‘Work over holiday‘ option is set to Yes in the shift editing. The holiday day is marked as a holiday (small icon) with the work schedule assigned in the Plan tab. In the report, the worked time is recorded as regular worked hours, and the row for the day is color-coded to indicate work on the holiday (for which an additional payment is due).
Public holidays are defined according to the holiday calendar. Currently, we offer the following holiday calendars:

The holiday calendar can be set for the entire company under Administration – Company – edit Company – General tab – Holiday Calendar. Unless specified otherwise, the calendar set here applies to all work groups and users.
If needed, a different holiday calendar can be assigned to specific users or entire work groups:
- in Administration – Work groups – edit work groups – General tab. In the General tab, the holiday calendar is set for the edited work group. The holiday calendar is either inherited from the company settings or a custom holiday calendar is assigned to the work group.
- in Administration – Users – edit user – General tab. In the General tab, the holiday calendar is set for the edited user. The holiday calendar is either inherited from the work group settings (the work group may have a holiday calendar inherited from the company or a custom holiday calendar) or a custom holiday calendar is assigned to the user.
The company has several foreign branches. Users will be divided into work groups based on the country they work in. Each work group can then have a different holiday calendar set. Users will have the holiday calendar assigned based on the work group they belong to.
The company has employees working abroad. The company has a holiday calendar set, and only specific users will have a different holiday calendar assigned.
Weekly uninterrupted rest period
(1) The employer is required to schedule working hours in such a way that the employee has an uninterrupted rest period of at least 35 hours per week. The uninterrupted rest period per week for a minor employee must not be less than 48 hours.
(2) If the employer's operation allows it, the uninterrupted rest period per week is set for all employees on the same day, so that it includes Sunday.
(3) In the cases specified in § 90, paragraph 2, and for technological processes that cannot be interrupted, the employer may schedule the working hours of employees over 18 years old in such a way that the uninterrupted rest period per week will be at least 24 hours, provided that the employees will be given an uninterrupted rest period over two weeks, so that the total duration of this rest period is at least 70 hours.
(4) If agreed, in agriculture, uninterrupted rest can be provided in such a way that the rest period will be given over a period of a) 3 weeks will total at least 105 hours, b) for seasonal work, uninterrupted rest can be provided in such a way that the rest period over a period of 6 weeks will total at least 210 hours.
When creating work schedules in the shift editing section, it is important to ensure the correct distribution of working hours.
Work schedules, whether it is fixed work, flexible work, fully flexible work, or free work, should be organized in such a way that the employee has an uninterrupted rest period of at least 35 hours per week (48 hours for minor employees), and if the employer’s operation allows it, the uninterrupted rest period per week is set for all employees on the same day, so that it includes Sunday.
The employee works a twelve-hour shift on Friday, which ends at 11:00 PM. The next work performance can be scheduled no earlier than Sunday at 10:00 AM. If the employee is called to work on Saturday from 3:00 PM to 11:00 PM, the employer can only provide uninterrupted rest after this shift, meaning the employee can start work on Monday no earlier than 10:00 AM.
